Do I need a poison centre notification?

Direct answer: Yes, if you are the EU importer or downstream user (formulator, repackager) placing a mixture on the market that is classified for health or physical hazards, you must notify it through the ECHA Submission Portal before it is sold. Substances, non-hazardous mixtures, and mixtures classified only as gases under pressure or explosives are out of scope.

Who is the notifier

The obligation sits with the company that places the mixture on the EU market: the importer bringing it in from outside the EU, or the downstream user who formulates, repackages or renames it. Distributors who only resell are currently not notifiers, but from 1 January 2027 a distributor who rebrands a product or sells it into a new member state must notify too, unless the poison centres already hold the information.

Which products are in scope

Any mixture with at least one health hazard class (acute toxicity, skin or eye damage, sensitisation, CMR, STOT, aspiration) or physical hazard class (flammable, oxidising, corrosive to metals and so on). Typical examples: cleaning products, paints and coatings, adhesives, car care, fuels and fuel additives, room fragrances, hobby chemicals.

Which are not

  • Substances (notify under CLP Article 40 instead)
  • Mixtures classified only as environmental hazards
  • Mixtures classified only as gases under pressure or explosives
  • Mixtures used only for scientific research and development

When

Before the product is placed on the market, in every EU/EEA country where it is sold. Since 1 January 2025 this applies to every hazardous mixture on the market, including products that were on sale before the rules came in.

What the notification contains

Trade names, your contact details, full composition with concentrations, classification and label elements, toxicological information, pH, colour and physical state, packaging, product category and intended use, and a UFI printed on the label. See our guide to what is missing from your SDS.
